Concurrence
Definition: Concurrence
The mens rea of an offense must concur with the actus reus both
temporally and motivationally.
Application: Concurrence
The voluntary act or omission that constitutes the actus reus of
the crime must be performed when the actor has the requisite mens
rea (temporal concurrence) AND
The mens rea must be the direct motivation for the act (motivational
concurrence).
It suffices for the mens rea of the crime to concur with some voluntary
act or omission.
Abondon Act
If there is no mental fault (a guilty state of mind) in concurrence
with the act, or if the mental state was abandoned and did not trigger
the act, then there is no criminal liability.
